1. General provisions
These general terms and conditions govern the use of the sweetdev.si website and the terms of business cooperation between SWEET HOUSE d.o.o. (hereinafter: the provider) and clients. By using the website or ordering a service, you agree to these terms. Personal data processing is governed by our Privacy Policy.
2. Provider information
SWEET HOUSE d.o.o., Celovška cesta 150, 1000 Ljubljana. Registration number: 8242658000. Tax number: SI 60349468. Email: [email protected]. Phone: +386 64 277 313.
3. Description of services
SWEET HOUSE d.o.o. offers web development, business process automation, and consulting services. Details of each service are agreed individually before work begins. Packages and prices on the website are informational; only a written offer or contract is binding.
4. Contract formation
A contractual relationship is established upon confirmation of an offer, signing of a contract, or written/electronic order of a service. An offer is valid for 30 days from the date of issue, unless stated otherwise.
5. Pricing and payments
All prices on the website are approximate. The final price is determined in a written offer or contract. Payment terms: 40% upon confirmation of the offer, 30% upon delivery of the first version, 30% upon launch, unless agreed otherwise. In case of late payment, the provider has the right to charge statutory default interest and reminder costs. Until full payment of all obligations, the provider retains the right to withhold all created files, access credentials, and materials.
6. Client obligations
The client undertakes to provide all necessary content (texts, images, logos, access credentials) in a timely manner as required for service delivery. The client warrants that they have the rights to use all provided content. Client non-responsiveness exceeding 30 days may result in project termination by the provider.
7. Scope of revisions
The project price includes 2 rounds of minor revisions (text changes, image replacement, minor visual adjustments). Substantial changes to concept, structure, or functionality are considered additional work and are charged at the applicable hourly rate by prior agreement.
8. Delivery timelines
Delivery timelines are estimated in the offer and are valid subject to timely content delivery by the client. Any delay in providing content or responses by the client proportionally extends the delivery timeline.
9. Copyright and intellectual property
Copyright and usage rights for created content transfer to the client only upon full payment of the agreed amount. Open-source components retain their licenses. SWEET HOUSE d.o.o. retains the right to use the completed project as a reference (name, screenshots), unless the client objects in writing.
10. Warranty and complaints
After launch, we provide free support for the duration depending on the package: 30, 60, or 90 days. During this period, we fix errors and deficiencies. Critical errors must be reported within 8 days of discovery. SWEET HOUSE d.o.o. does not guarantee specific results of advertising, SEO, or AI usage, as these depend on external factors.
11. Limitation of liability
SWEET HOUSE d.o.o. is not liable for indirect damages, lost profits, or data loss. Total liability in connection with any individual project is limited to the amount paid by the client for the service, unless mandatory legislation provides otherwise.
12. Termination of cooperation
The client may terminate cooperation at any time. In case of withdrawal, all completed work is charged. The provider retains the right to terminate in case of: material breach of these terms, payment delay exceeding 14 days despite a reminder, or client non-responsiveness exceeding 30 days.
13. Consumer rights (ZVPot)
Due to the nature of services customized for each client, by placing an order the consumer (natural person) expressly agrees that the provider begins service delivery before the expiry of the 14-day withdrawal period (Article 43.č of ZVPot-1). The consumer thereby loses the right to withdraw from the contract after service delivery has begun.
14. Confidentiality
Both parties undertake to treat all data and information obtained during cooperation as confidential and shall not disclose them to third parties without written consent, unless disclosure is necessary for service delivery or required by law. The confidentiality obligation continues after the end of cooperation.
15. Force majeure
SWEET HOUSE d.o.o. is not liable for delays or non-fulfillment of obligations due to force majeure circumstances (natural disasters, pandemics, infrastructure outages, strikes, or other unforeseeable events). Timelines are extended accordingly. If circumstances persist for more than 60 days, either party may withdraw without liability.
16. Dispute resolution
In accordance with Article 32 of the Consumer Dispute Resolution Act (ZIsRPS), SWEET HOUSE d.o.o. hereby informs that it does not recognize any out-of-court consumer dispute resolution provider as competent. Consumers can find information about dispute resolution bodies in the EU at: https://consumer-redress.ec.europa.eu/dispute-resolution-bodies
17. Applicable law and jurisdiction
These terms are governed by the law of the Republic of Slovenia. The parties shall endeavor to resolve any disputes amicably. In the event of a dispute, the District Court in Ljubljana shall have jurisdiction.
